Terms of Service

Welcome to Nord Kapek. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Nord Kapek ("Company", "we", "us", or "our"), governing your access to and use of our automated trading software, analytical tools, web interface, and related technology services (collectively, the "Platform").

1. Acceptance of Terms

By registering an account, connecting external exchange credentials, or utilizing any portion of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms in their entirety, you must not access or use the Platform.

2. Eligibility and Regulatory Boundaries

To use Nord Kapek, you must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess full legal capacity to enter into binding agreements. Access is strictly prohibited to individuals located in or citizens of jurisdictions where algorithmic cryptocurrency trading, derivative digital assets, or cross-border automated investment services are unlawful under local regulations. In the United Kingdom, users must evaluate whether their activities adhere to Financial Conduct Authority (FCA) directives regarding cryptoassets.

3. Nature of the Service

Nord Kapek operates as a technical intermediary offering proprietary algorithmic modeling, automated execution routines, and quantitative market data integration. Nord Kapek is not a bank, broker-dealer, asset manager, or financial custodian. At no point does Nord Kapek hold, store, or take possession of client fiat currencies or digital assets; all funds reside in your accounts held with third-party exchanges or custody providers that you connect via API keys.

4. User Responsibilities and Security

You agree to maintain the strict confidentiality of your account credentials, API tokens, and two-factor authentication devices. You bear sole responsibility for any instructions, trading orders, or API executions initiated under your account. You agree not to:

  • Reverse-engineer, decompile, or copy the algorithmic software or underlying neural models;
  • Grant automated API permissions allowing withdrawal or asset transfer privileges;
  • Use the Platform to execute market manipulation, spoofing, wash trading, or violate anti-money laundering laws;
  • Bypass rate limits, security barriers, or server integrity controls implemented by the Company.

5. Risk Acknowledgement and Algorithmic Execution

Automated and algorithmic cryptocurrency trading carries extreme market volatility and systemic technical risks. Slippage, exchange latency, API downtime, liquidity drops, and unforeseen market conditions may cause trades to execute at prices significantly different from simulated projections. You expressly acknowledge that historical performance and backtested simulations displayed on the Platform do not constitute a guarantee of future profits.

6. Intellectual Property Rights

All software architecture, algorithmic logic, user interface designs, trademarks, text, graphics, and documentation associated with Nord Kapek remain the exclusive property of the Company and its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to access the Platform solely for personal and internal trading operations.

7. Fees, Subscriptions, and Payments

Certain advanced modules, high-frequency execution pipelines, and premium analytical tiers require payment of recurring subscription fees or performance-based software licenses. All fees are clearly disclosed prior to activation and are strictly non-refundable, except where required by mandatory consumer protection legislation in the United Kingdom.

8. Limitation of Liability

To the maximum extent permitted under applicable law, Nord Kapek, its directors, employees, and software architects shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including without limitation loss of profits, trading capital, data, goodwill, or exchange insolvencies resulting from your use of or inability to use the Platform.

9. Termination and Suspension

We reserve the right to suspend or terminate your account and API access immediately, without prior notice, if we reasonably suspect fraud, security compromise, illegal activity, or a material breach of these Terms. Upon termination, your right to use the Platform ceases immediately.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of London, United Kingdom.

11. Amendments to Terms

We may modify these Terms at any time to reflect software enhancements, regulatory changes, or operational necessities. Updated versions will be published on the Platform with a revised effective date. Continued use of Nord Kapek following such changes indicates your ongoing consent.
